Caro Joefox, ti segnalo questa cosa nella speranza che un esperto come te possa aiutarmi a capire di che cosa si tratta e a dissolvere i timori che mi hanno assalito a una prima lettura della questione in oggetto.

Ho trovato su un sito inglese un riferimento a nuove proposte di modifica della Commissione Europea alle norme sulla pesca. Vi si fa riferimento a un futuro divieto della pesca, anche sportiva e ricreativa, con "proiettili di ogni tipo". Ho paura che un'interpretazione estensiva del termine "proiettile" possa comprendere anche l'asta di un fucile subacqueo, e la cosa è preoccupante.

Il documento in discussione parla dell'Atlantico ed esclude il Mediterraneo, ma creerebbe comunque una "crepa" (capace nel tempo di allargarsi) nella normativa europea, dopo il regolamento di un paio di anni fa, che ammetteva la pesca sportiva col fucile.

Purtroppo la mia non perfetta conoscenza della lingua inglese e degli ordinamenti comunitari non mi permette di capire esattamente che cosa stia bollendo in pentola.

Please see attached consultation from the European Union on changes to the current Technical Conservation Regulations.

 

Specifically paragraph 2 of the covering letter:

“The Commission’s proposal will apply to all commercial and recreational fishermen and replace the current technical conservation rules in Regulation (EC) no. 850/98 (the Technical Conservation Regulation).”

 

and Article 12 of the Tech Con review document:

 

Article 12

 

Destructive fishing practices

 

The catching, retention on board, transhipment, storage, landing, sale, display or offer for sale of marine organisms caught using methods incorporating the use of explosives, poisonous or stupefying substances, electric current or any kind of projectile shall be prohibited.

 

This is a significant change from the current legislation which is Article 31 of Council Regulation 850/98 which permits spear fishing but prohibits the sale of fish caught using a projectile.;

 

Article 31

 

Unconventional fishing methods

 

1. The catching of marine organisms using methods incorporation the use of explosives, poisonous or stupefying substances or electric current shall be prohibited.

 

2.The sale, display or offer for sale of marine organisms caught using methods incorporating the use of any kind of projectile shall be prohibited.

Ciao,

 

premesso che non conosco in modo approfondito questo documento del 2005, ti posso dire che secondo me con "projectile" pensavano a tutto meno che alla pescasub, anche se teoricamente il dardo che scagliamo col fucile ad aria o a elastici è a pieno titolo un "projectile".

La regolamentazione riguarda il Baltico.... e non so come sia concretamente applicata, onestamente vedo altri pericoli meno remoti.

Sì, sì, per carità. Ma non si tratta del Baltico. Qui c'è il rischio che la pesca anche ricreativa con "proiettili di ogni tipo" venga vietata in mezza Europa.

Da quel che si capisce, si tratta di tutte le acque europee esclusi Baltico e Mediterraneo, per fortuna. Ma capirai che, così, si creerebbero premesse tutt'altro che belle anche per noi in prospettiva futura.

Non conoscevo questo testo, peraltro disponibile in italiano.

Lo studierò con calma, ma l'impressione resta invariata, oltretutto la dicitura "proiettile" in italiano mi appare più rassicurante.

La situazione è balorda, altrochè. Gli amici inglesi sono molto preoccupati. E a questo punto non solo loro.

Post da un forum inglese:

Hi all, i have just spoken to DEFRA (Department for environment, food and rural affairs) and the MFA ( Marine fisheries Agency) they have both informed me that as it stands if after the consultation this were to become law, spearfishing would be banned in the north Atlantic, thus banning spearfishing in the UK, Ireland, and effecting Spain, Portugal and France. Both agencies explained that this process was part of 'tidying up regulations' and linked in with greater control of all recreational fishing activities. It seems that this process could take between 18months and 2 years and that during this time it is 'up to us' to put our points across and try and have this proposed legislation altered. I was informed by Mr Benin at DEFRA that proposals such as these were based on 'scientific evidence and advice from industry' and advised to look at the EU webpages (Fisheries), but not that the evidence would be there.
